Press Release: Handybar® Infringement and Piracy


Rimco Resources USA of Ventura California has been the official manufacturer of the patented Handybar® since 2003. Rimco Resources USA and its counterpart Rimco Resources Hong Kong engaged with Kam Kai Manufacturing to build the Handybar®. Together with Rimco Kam Kai has now stolen Avenue Innovation Inc's tools to make counterfeit product and approach our customer base. They have also set up websites which directly sell our product.

After falsifying information to the Chinese government Kam Kai obtained a design patent on the Handybar® in 2008 five years after starting to build. We have been told by our Chinese intellectual property lawyers that the patent is invalid and holds no weight.

Our current model Handybar® is covered under our original Chinese Patent ZL00812831.6 granted January 26 2005 and our Hong Kong Patent HK1049648 granted December 22 2006 and also our Chinese Trademark.

Rimco Resources USAs counterpart Rimco Resources Hong Kong has provided enough evidence to prove piracy patent and trademark infringement. Rimco USA and Rimco HK are asking for more than $50000 USD in order to release our tools. They claim it is for unused materials. Avenue Innovations Inc. has ordered only finished product by container and have never been responsible for ordering raw materials.

Avenue Innovations Inc. has no outstanding debt with Rimco USA and all tools are bought and paid for however Rimco USA will still not hand over our tools.

This is the second time Rimco Resources has approached our customers from the back door. In November 2007 Rimco Resources HK approached our Australian distributor to sell product at a reduced price thus infringing on yet another patent. At this time Avenue sought another manufacturer. In turn Kam Kai and Rimco USA have told us that we must order from them at their price if we want product. Kam Kai has also tried to stop us building in our new Chinese facility.

Avenue Innovations Inc. has reached out to the Anti Corruption department (ICAC) in China and they promise a full investigation. Any product purchased from Kam Kai Rimco Resources or the newly formed Hang Fung Corporation will be seized by Chinese or U.S. Customs. We have also filed a complaint with the (ICPEN) International Consumer Protection & Enforcement Network and the U.S. Canadian Federal Trade Commission.
